Fugaki Terms of Service
Last updated: October 10, 2026 (added a notice of an amendment; the articles currently in effect are those of September 21, 2026)
Article 4 will be amended on December 1, 2026 (scheduled). The amended article is posted at the end of this page. Until then, the current Article 4 below applies.
These Terms of Service (the “Terms”) set out the conditions for using “Fugaki”, a music score creation service (https://fugaki.app/ and its API; the “Service”) provided by 大金 怜史 (“we” or “us”). Persons who use the Service (“Users”) shall use the Service after agreeing to these Terms.
Article 1 (Content of the Service)
- The Service is an application that lets Users create, edit, play back, print and export music scores in a web browser.
- Score data created by a User is saved in the User’s browser (local storage, etc.). In normal editing and saving, it is not sent to our servers, and we do not back it up. Users shall preserve their own data as needed, for example by exporting it to a file.
- With a paid plan, Users can use a function that imports a PDF score and converts it into score data (“PDF import”). In PDF import, the User’s PDF file is sent to our server and is deleted when the conversion ends. The conversion result is erased from our server when the User receives it in the browser, or at most 30 minutes after the conversion ends.
- In addition to the preceding paragraph, if a User attaches score state data on their own when sending feedback, that data is sent to us.
Article 2 (Accounts)
- The basic functions of the Service can be used without an account. Using a paid plan requires signing in with a Google account.
- Users shall manage their accounts at their own responsibility and shall not let any third party use them. We are not liable for damage arising from the use of an account, except where we are at fault intentionally or negligently.
- A person under 18 years of age who applies for a paid plan shall apply after obtaining the consent of a parent or guardian.
Article 3 (Prohibited Acts)
In using the Service, Users shall not engage in any of the following acts.
- Acts that violate laws and regulations or public order and morals
- Acts that infringe the copyright or other rights of third parties (including copying or distributing scores without the permission of the rights holder)
- Acts that place an excessive load on the servers or network of the Service, unauthorized access, reverse engineering, and large volumes of requests by automated means
- Acts of transferring, lending or reselling an account or the rights to a paid plan to a third party
- Acts, equivalent to those in the preceding items, that specifically harm the operation of the Service or the rights of other Users or third parties
Article 4 (Paid Plans and Fees)
- We provide the following paid plans. All fees are monthly amounts including tax.
- basic plan: 300 yen per month. PDF import of up to 3 files per month
- pro plan: 800 yen per month. PDF import of up to 100 files per month
- The PDF import allowance is counted per calendar month, and the number of files used resets to 0 at 0:00 on the 1st of each month (Coordinated Universal Time; 9:00 on the 1st in Japan time). This counting period differs from the billing period in the next paragraph (which is counted from the application date). Unused allowance does not carry over to the next month. A User who applies in the middle of a month can use the full allowance for that month, and when a User changes plans, the number of files already used in the current month carries over.
- Fees are paid by credit card through the payment processing service we use (Stripe). The first monthly fee is charged at the time of application, and thereafter payment is made automatically on the same day each month counted from the application date (or on the last day of the month in months that have no such day) (automatic renewal). The contract period is one month, and it is renewed automatically unless canceled.
- Users can cancel at any time from “Manage plan” in the app (the Stripe customer portal). Cancellation stops the next automatic renewal, and the User can continue to use the plan until the end date and time of the current contract period shown in the portal. To stop the next payment, cancel before the end date and time of the contract period.
- For cancellation for the User’s own reasons, we do not refund fees already paid (including prorated refunds). However, this does not apply where the cause is attributable to us, where a refund is required because of the cancellation, rescission or the like of the contract under laws and regulations, or where these Terms provide for a refund.
- If a User changes plans in the middle of a contract period, the new plan applies immediately and the difference is settled on a prorated basis. For a change to a higher plan, the difference is charged at that time; for a change to a lower plan, the difference is deducted from subsequent charges. Any remaining balance not used for such deductions is not refunded upon cancellation.
- If a payment is not completed (for example, because the card has expired), we may stop providing the paid plan and return the User to the free plan.
- We may change the fees or the content of plans (including allowances). In that case, we will announce the content of the change and its effective date by displaying it on the Service or by email at least one month before the effective date. Changes disadvantageous to Users, such as fee increases or reductions in allowances, apply from the first contract renewal that comes after the announcement and do not apply to contract periods already paid for. If, for our own reasons, we stop providing the main functions during a contract period already paid for, we will refund the fee for the unexpired portion of that period.
Article 5 (Intellectual Property Rights)
- Using the Service does not transfer to us any rights that Users or third parties have in scores or musical works. We do not use Users’ score data except to the extent necessary for processing requested by the User, such as PDF import.
- Rights relating to the Service itself (programs, design, text, etc.) belong to us or to the legitimate rights holders.
- Scores that Users use for PDF import are limited to those for whose use the User has the rights or permission.
Article 6 (Disclaimer)
- The Service is provided as is. We do not warrant that the Service is free of defects, that it is fit for a particular purpose, or that it can be used without interruption.
- PDF import is automatic recognition by computer, and we do not warrant the accuracy or completeness of the reading results. Users shall check and correct the reading results at their own responsibility.
- Because score data is saved in the User’s browser, the data may be lost because of deletion of browser data, failure or loss of the device, changes in browser specifications, etc. We are not liable for loss of data that is not due to causes attributable to us. Where we are liable for damages, the following paragraphs apply.
- Except where we act with intent or gross negligence, the amount of damages we owe for damage incurred by a User in connection with the use of the Service is limited to the greater of the fees that User paid us in the most recent 12 months or 1,000 yen.
- Where we act with intent or gross negligence, the limit in the preceding paragraph does not apply.
Article 7 (Changes, Suspension and Termination of the Service)
- We may temporarily suspend all or part of the Service without prior notice because of maintenance, failures, outages of external services, or other unavoidable reasons.
- We may change the content of the Service or end its provision. If we end it, we will in principle announce this on the Service or by email at least one month in advance, and we will refund fees for the unexpired period of paid plans. Changes relating to the main functions of paid plans are governed by Article 4, Paragraph 8.
Article 8 (Suspension of Use and Withdrawal)
- If a User violates these Terms, we will notify the User of the violation and request correction within a reasonable period; if it is still not corrected, we may suspend the User’s use of the Service or cancel the paid plan. Where leaving the matter unaddressed could cause serious damage to us or third parties, such as unauthorized access, attacks on servers, or serious infringement of third-party rights, we may suspend use without prior notice.
- When we suspend the use of a paid-plan User under the preceding paragraph, the paid plan is treated as canceled. Fees for the period up to the date of cancellation are not refunded, and fees for the unexpired portion from the date of cancellation onward are refunded. However, in the case of a violation due to the User’s intent or gross negligence, we may deduct the amount of damage we have suffered.
- Users can delete their account (withdraw) at any time from “Delete account” on the “Plan” screen in the app (we also accept requests sent to feedback@fugaki.app). If a User deletes their account while using a paid plan, the paid plan is canceled at that time and fees for the remaining contract period are not refunded (except in the cases in the proviso of Article 4, Paragraph 5). This treatment is also shown on the deletion confirmation screen.
Article 9 (Changes to These Terms)
We may change these Terms in accordance with Article 548-4 of the Civil Code when the change conforms to the general interest of Users, or when the change does not contradict the purpose of the contract and is reasonable in light of the necessity of the change and the appropriateness of its content. If we change these Terms, we will announce the content of the changed Terms and their effective date by displaying it on the Service or by email at least one month before the effective date. Changes that do not meet these requirements will be made with the individual consent of Users.
Article 10 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute relating to the Service shall be resolved by a court that has jurisdiction under the Code of Civil Procedure or other laws and regulations.
Amended Article 4 to apply from December 1, 2026 (scheduled)
Under Article 9, from December 1, 2026 (scheduled), Paragraphs 1 and 2 of Article 4 are amended as follows. Paragraphs 3 to 8 are not amended (the paragraph numbers cited in Articles 7 and 8 also remain the same). If the effective date changes, we will announce it again.
Article 4 (Paid Plans and Fees)
- We provide the following plans. All fees for paid plans are monthly amounts including tax.
- Free plan: no fee. Signing in with a Google account is required. PDF import of up to 1 page per month (limited to 1-page PDFs)
- basic plan: 300 yen per month. PDF import of up to 10 pages per month
- pro plan: 800 yen per month. PDF import of up to 300 pages per month
Users who have a basic plan or pro plan contract as of 24:00 on November 30, 2026 (Japan time) (including Users who applied after the announcement of the amendment and have a contract at that time) may, notwithstanding the above limits, use PDF import for up to 60 pages per month on the basic plan and up to 2,000 pages per month on the pro plan, as long as the contract for the same plan continues without interruption. If the contract ends through cancellation, or if the User changes to a different plan during the contract, this treatment ends and the above limits apply thereafter. Even if a payment is not completed, if the payment is completed within the retry period of the payment processing service and the contract continues, the contract is not treated as interrupted.
The PDF import allowance is counted by the number of pages of the imported PDF. When an import starts, the number of pages of that PDF is deducted from the allowance; if the import stops partway, the number of pages that could not be read is restored to the allowance, and if the import fails, the number of pages deducted is restored to the allowance. If no conversion is performed, the number of pages deducted is also restored (in each case subject to the receipt condition below). These restorations are made, to the allowance for that month, when a receipt issued by the conversion server reaches us from the app by the end of the month to which the day the import started belongs (one month being the period from 9:00 on the 1st of each month to 9:00 on the 1st of the following month (Japan time)). The app automatically obtains the receipt again, for example the next time it is started within that month. If the receipt does not reach us by the end of that month, the number of pages deducted is not restored. If the month ends without the app being opened, the pages may not be restored. Please open the app at least once within the month of the import. A PDF imported at one time may have up to 40 pages (any change to this is governed by Paragraph 8).
- The PDF import allowance is counted per calendar month, and the number of pages used resets to 0 at 9:00 on the 1st of each month (Japan time). This counting period differs from the billing period in the next paragraph (which is counted from the application date). Unused allowance does not carry over to the next month. A User who applies in the middle of a month can use the full allowance for that month, and when a User changes plans, the number of pages already used in the current month carries over.
